The Club operates as a Private Membership Association or PMA. Private clubs are organizations with members that gather and network under similar interests. They afford unique protections under Federal law that operating a commercial storefront does not provide. “We are an organization of craft cannabis enthusiasts that gather around a commodity that we produce better than any of the commercial options that are oftentimes low quality, expensive, lackluster and quite frankly, don’t do the job they are intended to do”, says John.
Private clubs typically require individuals to become members before they can access the club’s facilities and services. The club may have eligibility criteria for membership, such as age restrictions or other qualifications. In our case, you would need to be a cannabis user over the age of 21 to become a member. We conduct an initial interview with prospective members either over the phone or in person and decide whether or not the prospective member and the Club would benefit from their membership. We don’t accept everyone as a member, and some people are put on a waiting list with Delaware residents given top priority. Some information regarding the protections of Private Membership Associations
Freedom of Association:
PMAs are protected by the constitutional right to freedom of association, allowing them to govern themselves and set their own rules. Private Membership Associations are Constitutionally protected under the 1st and 14th Constitutional Amendments.
Legality
The Supreme Court has ruled every time it needed to that members of an association do not fall under the jurisdiction of local, state, and federal governments and corresponding laws and regulations. The exception to this general rule is when the activities of the private membership association “present a clear and present danger of substantive evil”. Cannabis is pretty much legal in most places that it is not, therefore could never be considered as such a monstrous idea that people would organize an association around it, even in states where recreational cannabis is still technically illegal in states like Pennsylvania. People depend on cannabis regardless of legality. That’s just a fact.
